Legal & Policies

Agreement. These terms govern engagements between you (“Client”) and BrandOrbitWorks (“Agency”), 99441 Mellinger Strasse 10 Magdala, Germany. A project begins when a written scope or invoice is accepted and, where applicable, payment is received.

Scope & changes. Deliverables, timelines, and fees are defined in the agreed statement of work. Material scope changes require written confirmation and may adjust fees and schedules.

Fees & payment. Invoices are due within 14 calendar days unless otherwise stated. Late amounts accrue interest at 9% p.a. above the ECB base rate. Payment links are provided for secure card settlement; remittance details appear on each invoice.

Client duties. The Client supplies timely content, credentials, approvals, and feedback. Delays in client inputs extend delivery dates on a day-for-day basis.

Intellectual property. Upon full payment, the Agency assigns to the Client all rights in final, client-specific deliverables. The Agency retains ownership of pre-existing tools, frameworks, and generic know-how, and may reference non-confidential work in its portfolio unless prohibited in writing.

Confidentiality. Each party protects the other’s non-public information with at least reasonable care and uses it only for the engagement.

Warranty & liability. Services are performed with professional care. For 90 days after handover, the Agency will fix reproducible defects in delivered work at no charge. To the extent permitted by law, liability is limited to the fees paid for the affected deliverable; neither party is liable for indirect or consequential damages. Mandatory liability under the German Product Liability Act remains unaffected.

Termination & law. Either party may terminate for material breach with 14 days’ cure period. Upon termination, fees for work performed become due. German law applies; the courts of Erfurt have exclusive jurisdiction, without prejudice to mandatory consumer forums.

How we use cookies. BrandOrbitWorks uses cookies and similar technologies to operate the site, remember choices, and — with your consent — measure traffic and improve campaigns.

Strictly necessary. Session integrity, security tokens, and load balancing cookies are required for the site to function and do not require consent.

Preference. Your cookie-banner decision is stored in local storage under the key brandorbitworks_cookies_accepted so we do not re-prompt on every visit.

Analytics & marketing. With consent, we may set analytics and advertising cookies to understand page performance and measure paid acquisition. You can withdraw consent at any time by clearing site data in your browser or contacting [email protected].

Managing cookies. Most browsers let you block or delete cookies under settings. Blocking strictly necessary cookies may impair core features. Third-party embeds (such as maps) may set their own cookies per their policies when loaded.

Retainers. Monthly retainers are billed in advance. You may cancel before the next billing cycle; the current cycle remains non-refundable once work has commenced. Unused retainer hours do not roll over unless agreed in writing.

Fixed-scope projects. Project deposits are non-refundable once discovery or design work has started, as they reserve delivery capacity. If BrandOrbitWorks cancels an engagement without cause, prepaid fees for undelivered milestones are refunded within 14 business days.

Milestone billing. Completed milestones are invoiced and non-refundable. In-progress milestone payments may be pro-rated for work not yet performed if you terminate for the Agency’s uncured material breach.

Digital goods & chargebacks. Custom digital deliverables are excluded from EU 14-day withdrawal rights once delivery begins with your express consent. Please contact [email protected] before initiating a chargeback so we can resolve issues quickly.

How to request. Email [email protected] with your invoice number and a brief description. Approved refunds are issued to the original payment method within 14 business days.
